The Supreme Court and Foreign Policy

One of the fundamental functions of a government is to build relations with other countries. These relations are founded on policies that guide the relationship to ensure limits are not surpassed. The United States of America has relations with almost two hundred nations worldwide. For this reason the United States foreign policy is a critical aspect in the governance of the country. American foreign policy has changed over time owing to the changes in the global society in terms of how countries advance and explore new ideas. Today, the American foreign policy involves a variety of functions some of which include establishing relations and maintaining diplomatic relations with other nations as well as international organizations such as the Unite Nations.

Most cases that arise from foreign policy are always solved by the congress. The Supreme Court’s role in foreign policy is limited some functions which include, cases to do with treaties, admiralty, maritime law, and ambassadors (Vile, 2014). It is also mandated to solve disputes that arise between states and as wells as those that arise from foreign states. Decisions made by the Supreme Court are considered final. Foreign policy is a mutual agreement for which parties involved are expected to be subject to. Since cases that arise from foreign policy involve two parties bound by an agreement, it is more effective to establish a judicial structure that is flexible in terms of decision. Cases such as those that infringe on human rights should be left for the congress because decisions on the same should allow for flexibility so that relations are maintained while at the same time resolutions to such problems are made.

Delay in judicial process

The supreme is the highest court in the United States. For this reason, the court receives the highest number of cases that are more often than not are considered serious cases. Whereas cases involving foreign policy are weighty, it is possible to solve those cases outside Supreme Court. This is to provide the court with enough time to handle other cases while at the same time overseeing the operations of the lower courts.

Inflexibility in decisions

Cases to do with foreign policy require some flexibility in terms of the decisions made. The Supreme Court being the final court may not be able to provide flexible decisions and it is for this reason that the congress should be allowed to debate over such issues and develop mutually acceptable decisions which will seek to maintain international relations.

Negative publicity

The Supreme Court should be able to protect the American citizens from injustice (Cohen, 2006). This is a key role the judiciary is entitled to play in any country. The citizens of the United States look up to the Supreme Court to undertake cases that involve them and make decisions that are fair. Lack of its involvement therefore will create a negative perception about the Supreme Court and this is vital for its survival and credibility.

Irresponsible court decisions

The Supreme Court is the highest court and its decision is considered final and functional. Its lack of involvement may result to insufficient justice from the executive or the legislature arm of the government. The essence of justice is for it to be fair and worth the crime. The Supreme Court is better positioned to make the decisions that the public can consider fair and worthwhile.

The Supreme Court and Constraints on Federal Government – Example And Explanation

Goldwater v. Carter, 444 U.S. 996 (1979)

The court involved with the Goldwater v. Carter, 444 U.S. 996 (1979) acknowledged that the conclusion should not be made if it is not ready for judicial review. The court’s decision convinces me that the dispute between the President and the Congress is not ready for judicial assessment until every branch has taken action declaring its constitutional authority. Apparently, disputes and differences between the Congress and the president are usual under the U.S system. Always the differences consistently turn on political instead of legal concerns (Cohen, 2006). Conversely, the Judicial Branch should not make a decision regarding and affecting the distribution of power between the Congress and the President, until the political parties attain a constitutional standoff. If not, we would motivate individual Members in the Congress to seek out for the judicial ruling of disputes before an ordinary political procedure has a chance to determine the conflict.

In this case, a small group of the Congress argues that the President’s act of ending the treaty with the Taiwan has disadvantaged them of their constitutional responsibility on an adjustment to in the Supreme law of the country. As a consequence, the Congress did not take any official action (Cohen, 2006). However, the Senate considered a declaration stating that the Senate endorsement is essential and paramount for the ending of the all the defense treaty. Furthermore, it is not clear if the decree will have a retroactive effect. Also, it is unclear whether the Congress or the Senate disputed the President’s allegation.

In my view, this case portrays that the Supreme constraint to handle the case and also displays a political incompatibility with the Courts willingness to determine if a particular branch of the U.S Government has intruded and imposed the power of another branch of the Government. However, the Supreme Court has the responsibility to determine if both the Legislative and Executive Branches have constitutional responsibilities to play in the ending of the Taiwan treaty.  For instance, if the Congress was given an opportunity to challenge the authority of the President to terminate the agreement, the considerable uncertainty could have severe consequences for the United States (Goldwater v. Carter, n. d). Consequently, in this case, it is the responsibility of the Supreme Court to resolve the dispute.

The case is not justifiable because it comprises of the decision of the President while conducting the affairs of the country and how far the Congress and the Senate are certified to counteract the actions of the President. For example, in Coleman v. Miller case, members of Kansas Parliament brought an act, which attacked the vote of the Senate in favor of the approval of the Child Labor Amendment. Additionally, I believe that the Goldwater v. Carter, 444 U.S. 996 case follows the Coleman v. Miller case, where the both cases are not justifiable (Goldwater v. Carter, n. d). They are political disputes that should be resolved by the both the Legislative and Executive Arms of the Government.  While the Constitution should be expressed and addressed in a way in which the Senate participates in the endorsement of the treaty.

In conclusion, the case brought division to the Justices of the Supreme Court. However, the judges found the case not justifiable. Further, they believed that the case comprised of a political question; how the Congress and the President would carry out the foreign affairs of the country. Thus, the Judges did not find the case ready and ripe for judicial review.

Human Trafficking International Treaty / Traffic in Persons Protocol

The Traffic in Persons Protocol, also known as the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children is an international human trafficking treaty adopted by the United Nations General Assembly in 2000. This treaty has a number of important elements. It details what defines criminalization of trafficking in persons as well as how victims of trafficking can be protected. Moreover, the Traffic in Persons Protocol defines status of victims of human trafficking across member states (United Nations, 2000).

The Traffic in Persons Protocol has results that help to guide member states on how they should respond to crimes related to human trafficking. For instance, it provides for the confiscation of instruments that are used by criminals to harm trafficked persons (Olson, 2015). Furthermore, the Traffic in Persons Protocol ensures that human trafficking victims are not punished by member states for getting involved in either trafficking or immigration violations. Generally, the treaty helps to prevent and combat trafficking of persons and protects human trafficking victims, especially women and children, against revictimization. Article four of the Traffic in Persons Protocol however states the exceptions for which the treaty should not be implemented. The Traffic in Persons Protocol cannot be implemented on offenses where there is no human trafficking and in cases where human trafficking is not transnational in nature. Furthermore, state parties involved in the Traffic in Persons Protocol are prohibited from implementing the treaty’s elements when human trafficking crimes do not involve an organized criminal group (United Nations, 2000).

Although the Traffic in Persons Protocol was adopted by the United Nations General Assembly, the United Nations Office on Drugs and Crime, (UNOD), is responsible for its implementation. The treaty was formed mainly to offer practical help to member states on how to draft anti-trafficking laws. All member states are obliged to prevent human trafficking and to protect human trafficking victims while promoting increased cooperation among themselves (United Nations, 2000).

Water and Sanitation in Haiti : A Global Health Issue

Haiti is the most impoverished nation in the Western hemisphere and is home to nearly 10 million people (Central Intelligence Agency [CIA], 2014).  The nation occupies less than 28 thousand square kilometers on the Western half of the island of Hispaniola situated in the Caribbean Ocean and is prone to devastating natural disasters including hurricanes, earthquakes, and typhoons (World Health Organization [WHO], 2012).  Natural disasters removed, Haitians struggle to survive.  Waterborne illnesses including cholera, typhoid, hepatitis, and chronic diarrhea are among the leading causes of death for all age groups in Haiti (WHO, 2012).  Although awareness and aid have grown over the past few decades there is still much progress needed and there are more lives to be saved.

Significance of the Issue

More than 2.5 billion people worldwide have no access to basic sanitation resulting in the deaths of an estimated 3.5 million people including 1.6 million children annually (Wake & Tolessa, 2012).  Zeroing in on Haiti, 80% of the rural population has no access to sanitation and open defecation is commonplace (International Federation of Red Cross and Red Crescent Societies [IFRC], 2010).  The result is contamination of already limited water sources that are used for cooking, drinking, and bathing.  In early 2010 a magnitude seven earthquake resulted in devastating destruction of an already crumbling infrastructure, loss of an estimated 160,000 lives, and displacement of nearly 1.5 million people (Bliss & Fisher, 2013).  An outbreak of cholera followed that infirmed greater than 670,000 and killed more than 8,000 people over the next 3 years (Bliss & Fisher, 2013).  A ten year plan was initiated by the Haitian government to eliminate cholera by means of improved sanitation, clean water supply, and education of citizens on proper hygiene practices.  According to Bliss and Fisher (2013), this was projected to cost around $2.2 billion over the ten year period with the United States providing more than $95 million in the immediate post-outbreak phase alone.

Current U.S. Global Health Policies/Initiatives

The United States Agency for International Development (USAID) is committed to improving life in the global community on many fronts including water and sanitation.  The agency launched its first global Water and Development Strategy in 2013 with a focus on  sustainable improvements in water supply, sanitation, and hygiene (WASH) (USAID, 2013).  The plan is projected to sustainably improve access to clean water for more than 10 million people and improve sanitation for more than 6 million people worldwide, including in Haiti over five years.  In addition, the U.S. is aiding Haiti’s 5.5 million farmers to improve the safety and abundance of their harvest through sharing valuable agricultural cultivation, irrigation, and fertilization techniques (USAID, 2013).b

Who Else is Helping?

There is an army of other nations and organizations participating in various capacities in the efforts to improve water and sanitation in Haiti.  The Regional Coalition on Water and Sanitation to Eliminate Cholera in Hispaniola was organized by the Pan American Health Organization/World Health Organization, the Centers for Disease Control and Prevention, and the United Nations International Children’s Fund in 2012.  It has grown in membership since its inception to 21 members and functions to train Haitian technicians on epidemiology and outbreak surveillance and on setting up cholera treatment units as well as mobilizing resources towards meeting the goal of cholera elimination in Hispaniola by 2022 (Bliss & Fisher, 2013).

The Haitian government has established the National Directorate for Water Supply and Sanitation (DINEPA), charging it with the responsibility of rehabilitating the earthquake damaged water network in the Port Au Prince area, implementing sanitation projects throughout the country, establishing community level water committees, and training native water and sanitation professionals.  Also involved in the efforts are a montage of faith-based organizations and private sector groups as well as numerous countries including the European Union, France, the United Kingdom, Sweden, Cuba, Brazil, and France (Bliss & Fisher, 2013).

Forward Progress with More to be Done

DINEPA was established in 2009, just nine months prior to the devastating earthquake that shook the already fragile infrastructure of Haiti.  It arose out of pre-earthquake recognition of disease and pestilence related to poor water quality and lack of sanitation.  The agency had to almost immediately after being established, go into emergency response mode.  Although it is growing and slowly progressing toward the goal of cholera elimination, the agency remains in its infancy and struggles to transition from emergency response mode to routine operations mode.  Greater funding is required to assist this agency in its efforts to establish long-term, sustainable solutions to the water and sanitation problems in Haiti.  Collaborating with DINEPA with a greater goal of recruitment of a work force to include the private sector for the building and maintenance of public utilities, particularly in the rural areas where the most disparaged people reside is the greatest need (Wake & Tolessa, 2012).  Further energies are required also in the education of Haitians on hygiene and hand washing and the importance of clean water sources and adequate sanitation in the prevention of disease and illness.

Conclusion

Clean water and sanitation for residents of developed nations are often taken for granted.  Basic commodities such as these are considered luxuries in Haiti and many other poverty-stricken nations of the 21st century and billions worldwide struggle to survive without access to these seemingly standard utilities.  Illness and death directly related to lack of clean water and sanitation are rampant yet amenable. Efforts to address this global disparity have been underway for many years, but must be magnified if significant progress is to be made toward elimination of preventable waterborne illness and death.

You are considered to be an expert in false memories, and a local district attorney has therefore requested your expertise on the following case:

On Tuesday, March 6, 2007, a bank was robbed in Slidell, LA. It was just after opening time, 9:04 a.m., and there were barely any customers, when a car arrived and parked in the side parking lot of the bank. Two men came out of the car and walked to the entrance. Both wore dark clothing. Upon entering the bank, they held out guns and asked for the manager. When the manager identified herself, the smaller of the two robbers ordered her to open the safe. Meanwhile, the other robber, a tall, and burley man, walked around holding his gun in his outstretched arm, and threatening the remaining employees and customers. The manager complied and the smaller robber collected all the money and valuables from the safe. After five minutes, the big robber asked if his companion was ready to go. When he was, the two ran back to their car, and drove away.

The district attorney has asked that you create a presentation about false memory and explain how it might influence this case. He asks that you specifically address the following:

  • Describe false memory and false memory experiments. Use the CogLab experiment to illustrate false memory experiments, special distracters, and normal distracters.
  • Describe at least one research study from a peer-reviewed journal that investigated how eyewitness memory can be affected by false memories.
  • Explain how false memory might influence this particular case. Use specifics from the description of the case, the CogLab experiment, and research to support your answer.
  • Using evidence from the case, the CogLab experiment, and outside research, justify why eyewitness testimonies should or should not carry weight in criminal proceedings.
  • Discuss any procedures which can increase or reduce the occurrence of false memories when reporting eyewitness events.

Harley and Sub-Zero Case Study – Questions With Sample Answers

Workers at Harley and Sub-Zero Accept Pay Freezes and Cuts to Keep Their Jobs from Moving:

At Harley-Davidson, the company that makes the iconic motorcycle, union workers in Wisconsin agreed to an unusually long contract of seven years. During that seven-year period, the company has the right to freeze wages. There will also be higher health care expenses for workers. The company will also be allowed to use more casual workers who receive lower wages and probably will not receive health or retirement benefits. Why did workers accept this contract? Harley said that it needed to cut millions of dollars in costs to be profitable in an industry where sales have weakened and the timing of a recovery is unknown. Harley lost $55 million in the past year. One way to cut costs would be to move production to other states with lower labor costs or to move production to lower-cost countries. Harley put on the table the possibility that it would completely close its Wisconsin factories without the worker concessions and resulting labor cost savings. By voting to accept the concessions, workers received a verbal commitment that the factories would stay open, but no written guarantee. Some jobs will still be moved out of Wisconsin despite the concessions. But, some workers saw little alternative. As one put it, “I am too young to retire and too old to start over.”

A similar situation took place at Sub-Zero/Wolf, an appliance manufacturer. The company threatened to move jobs from Wisconsin to a lower-cost plant in Kentucky if workers did not agree to concessions. The unionized workers ended up agreeing to a 20% pay cut, followed by a freeze of wages and benefits for the following four years. As a result, the company will still move some jobs to other locations, but most jobs will now remain in Wisconsin.

A statute is a specific enactment of legislature that governs a given state or local authority. It is a specific law that sets proposition upon which courts derive legal decisions depending on circumstances. Statutory legislation therefore, is the process by which courts apply statutes in the justice processes. Certain cases that fall under statutory legislation require interpretation of the same since cases differ in nature despite falling under the same spectrum of jurisprudence. Statutes require interpretation because of their nature. Some statutes have plain meaning while others exhibit ambiguity and vagueness especially in terms of wording.

Statutes require interpretation by judges and the various tools are used to interpret statutes. Some of these tools include traditional tenets of statutory interpretation, legislative history, and purpose (Hames, 2015). The role of court decisions in the interpretation of the law is to show how legislation should apply in a given case since no legislation is always enacted to address all matters. Legislation may contain ambiguity for a variety of reasons one of which being the nature of the case for which it is supposed to resolve.

More often than not, words are usually imperfect symbols to derive intent. Despite being ambiguous, they meanings change over time. For example the word “let” may mean several things, some of which include prevent, hinder or allow. Additionally, statutes may constitute uncertainties and this happens especially during enactment of statutes. A statute may include among other things a need for a compromise such as catering to special interests group. Given these circumstances, the role of courts’ decisions in the interpretation of the law is critical to the understanding of situational cases as well as the requisite resolution to case.

Example

Assuming all motor vehicles are mandated by law to register with the Department of Motor vehicles for motorists to use public roads. If the statute does not define the word motor vehicle then the word motor vehicle will have to be defined/ interpreted in case a related issue arises in court. A motorist riding his motor cycle may be apprehended by traffic police for not registering with the Department of motor vehicles. The individual may argue that a motor cycle is not a motor vehicle. This is where the role of the court in interpreting statutes becomes critical in the judicial system.

The United States Supreme Court has handled an array of cases using statutory interpretation. The court has always held that the terms used in a statute should be interpreted as they are, that is, in literal form (Siegel, 2005). While the court is expected to effectuate and determine the intent of legislature using the plain meaning of the law, more often than not, the courts are subjected to cases whereby ambiguity of the law and the nature of the case do not allow for literal interpretation of the law. In such circumstance the court effectuates the purpose of the law by interpretation the law based on the nature of the case. Therefore, the role of the court in statutory interpretation is based on three general factors, which are, the nature of the case, the ambiguity of the statute and the reasonability of the courts.
