Two police officers were patrolling in a high-crime neighborhood. They noticed a parked car with two people inside (a driver and a passenger). One of the officers noticed the passenger making a shoving down motion, leading the officer to believe that the passenger might be armed. The officer reached into the car and touched a bulge in the passenger’s pocket. He felt large, hard objects which he believed to be rocks of crack cocaine. He then removed a plastic bag from the pocket. It contained several rocks of crack cocaine that, together with another rock found in the passenger’s clothing, totaled almost 100 grams. The passenger was arrested, but the driver and the woman standing outside it were not.

Should the passenger’s motion to suppress the seized evidence be granted? On a routine patrol, an officer noticed a parked car. Two people were inside, and they were in a high-crime area near a bar that was known for gang activity. In the past, the officer had responded to calls from the bar for everything from murder to public intoxication. After frisking them for weapons, the officer looked in the area where he observed the passenger fumbling with something to see if he was hiding a gun. The officer said he was checking this area for his safety and to make sure that nobody would get hurt. The officer observed a 12-pack of beer on the floorboard and checked inside for a gun. When he moved the carton, he found a small bag underneath it containing a controlled substance.

The concept or theme for my restaurant will be palm leaf restaurant. The key aspect of my theme is providing great food in a great environment and offering quality services that surpass customers’ expectation. The restaurant theme focus on providing extra environment beauty and peace that is currently not given much attention in other surrounding restaurants. The restaurant business will be a partnership business that will provide all types of meals including breakfast, lunch, and dinner. It will also provide beverages such as coffee and tea to cater for any customer who will be interested in the same at different time of the day. The restaurant will also sell soft drinks and snacks. It will be an all-inclusive restaurant.

The main purpose of considering a partnership business is due to the need a high amount of capital to start this business. The restaurant will be competing with a number of classic and prestigious restaurants and hotels located in the region and thus, to be able to compete, one has to start a standard restaurant. This will demand a high starting capital for renting the right place, doing interior decoration, purchasing the required restaurant facilities, doing exterior decoration, and running the restaurant before it makes any return. In this regard, a contribution from different partners will be a better way of raising cash rather than using a lone or search for funds elsewhere. The restaurant will serve all meals since it will be locate in a place where it can access all time customers and thus, it should be able to satisfy their needs.

Restaurant Business Plan

The Palm Leaf Restaurant will feature American dishes with some aspect of African-American and Spanish dishes. The restaurant will basically focus on creating a cool natural atmosphere by creating elegant exterior decoration focusing on natural beauty. The restaurant will also be carefully decorated in the interior with Spanish cozy and stylish influence. The restaurant will have 30 dining seats with 10 dining tables. It will also have a total of 15 seat lounge. The restaurant menu will be stirred from various cookery specialties and will consider a varied and extensive custom. The restaurant will provide a three business lunch course, three course prix fixe dinner in addition to normal menu. The restaurant will be opened on daily basis. Lunch will be served from in all days between 12:00 to 2:30 PM. Dinner will be offered from 5Pm to 10Pm from Monday to Thursday. On the weekends, dinner will be served from 5PM to 11 PM.  The lounge will remain open until 12 AM during the week and up to 2 AM over the weekends. The restaurant will always be opened at 6AM for breakfast. It will also offer tea and coffee at all times when the customers need them.

Before making decision on the kind of restaurant to open a market analysis was recommendable. The market research in this case focused on various business aspects that include the number of competitors in the region, their level of operation, their targeted customers, their cost of food and other restaurant services. Market analysis also focused on establishing the neglected customers as well as the strengths and the weaknesses of the existing restaurants in the areas. Among other evaluated aspects is the customers’ needs and establishing how well those needs are meant by the current restaurants. After obtaining all this information, the restaurant manager decided to establish a restaurant that caters for the largest population of the region.

The restaurant has designed its menu focusing on the local population as well as other foreigners interested in the local food or with new taste. The restaurant will be position close to a tertiary college in the north, a lake in the south and other businesses surrounding the area. Thus, the most anticipated customers will be students, lecturers, other college workers, local and foreign tourists as well as local business men and women and workers in the surrounding offices.  The surrounding community may also consider having a lunch or a dinner out during the weekend. The most anticipated customers are described below:

  • University students and workers: Students are targeted for they commonly eat outside the school in affordable restaurants especially those that also fit their definition of quality and taste. They take all their meals outside the school apart from breakfast that they can easily prepare from in their residential room. However, the more anticipated meal where the level of consumption is high is lunch. This is because it includes other university workers who normally commute to work. This implies that these individuals will take lunch within their working area but they will take breakfast and supper at their home. Thus the restaurant will always have more for lunch as compared to other meals. Coffee and tea meetings are also expected from business men with business meetings as well as during lecturers and students meetings.
  • Tourists: Most individuals who come to see the lake and participate in various water sports will be good customers for the restaurant for all meals.
  • Business men and women: The restaurant will also be anticipating a considerable number of customers from individuals who comes to the city to do their businesses
  • Workers: The restaurant will also be anticipating a good number of customers from the workforce. The restaurant would also target single men and women working in the surrounding for dinner.

Management Structure

The restaurant will be owned by four partners who will own the restaurant based on the amount of money each partner contributes. Being the originator of the idea, and the major active partner, I will however be responsible of operation management. The three other individuals will highly be involved in making serious decision in the restaurant especially mater pertaining financial use and generation of income. This is due to the fact that these matters are much more important and thus they can only be decided after consultations.

Some of the activities they will be involved in include hiring, designing the restaurant internal and external appearance, designing the restaurant menu, and deciding on the cost of various foods based on the cost of preparation among other things. In this regard, the restaurant will basically be monitored by me with regard to workers management, making purchases, recording sales, deciding on the amount to be cooked at what time, and taking orders and accomplishing them among all other operations that need to be done to enhance the daily restaurant operations. To enhance the restaurant operation, each group will be provided with leaders that will enhance chefs’ performance as well as waiters and cleaners. Those will play a major part in enhancing effective performance in the restaurant all through (The Economic Planning Group of Canada Halifax, Nova Scotia, 2008).

Financial Risk Assessment

Basically, every entrepreneur basically takes a risk while investing in any business. This restaurant business will also be experiencing a number of risks. One of the major risks is business returns. After setting out the business, the restaurant will have to invest more in marketing to ensure awareness. The level of awareness will highly depend on the number of customers the restaurant will manage to attract and this will determine the company’s financial position. One of the major challenges of running a restaurant business is the fact that food is highly perishable and if the amount prepared is not consumed it can only be considered as waste.

This will definitely be considered as waste. However, this may be reduced with extensive and thorough awareness. Another major challenge in this case is maintaining the attracted customer. The restaurant will have a challenge of maintaining the attracted customers by maintain a high quality of food and cleanliness. This will be the only way the restaurant will manage to win trusted customers to ensure that it has at least the minimum income that it will always manage at all times. Other financial challenges include need to pay workers, rent, and other fixed cost despite of the performance. Location of the Business

This restaurant will be located in Bethel a city in Alaska State of the United States of America. Bethel is situated close to the west of Alaska cost about 400 miles on the west of Port. The city has a population of 6080 individuals based on 2010 census. The restaurant will be located in the vicinity of Bethel Campus of Alaska University between the university and H-Marker Lake. The main advantage of the current location is that the restaurant has the ability to serve both students and workers from the campus as well as people operating in the lake either just for tourism purpose or for serious business.

This gives the restaurant an assurance of customers based on the effort the company wish to employ in decorticating its exteriors and interior parts of the restaurant.  Another major advantage is that the restaurant is at the vicinity of a number of Bethel cultural heritages and thus, it is more likely to get more tourist customers who come to see the cultural heritage of the city and the Alaska state. Another main advantage is that the rate of competition is not very high as there are n many restaurants focusing on this region and thus, the company has an opportunity to grow. The main challenge the resultant had to experienced based on the location is that there was no special building that would fit a more tourist based structure. To attract customers especially tourist at a high rate, uniqueness and embracing of the surrounding culture and beauty would be necessary. This can highly be achieved by making own design which is currently impossible due to capital limitation. The lack of the right building for this purpose limits the company’s efforts in making the restaurant more attractive to the tourist. This can only be compensated by quality products and interior designs (Quick Facts Census, 2015).

Restaurant Menu

The restaurant will focus on drinks, food, snacks, and disserts. Among the drinks that the restaurant will provide include coffee, tea, milk, soda, and juice. Among the snacks to be provided include hot dogs, pizzas, burger, donut, biscuits, and cookies. The restaurant will also offer disserts that include ice cream cake. The restaurant will also offer a number of food meals that include Spanish rice, twice-baked potatoes, meatloaf, green beans, city chicken, chicken sandwich, barbecue, beef, fish, Mashed potatoes, and mashed pumpkin. This food is selected because it is among the most favorable food in America. The menu focuses on all communities that live in Bethel which include Whites, Latino (Spanish), and African-American. The menu does not cater for tourist since it is believed that foreign tourists would be more interested with learning more about the local products and food. In this regard, they are anticipated that they will consider trying any local food to establish the difference between the American culture and their culture. The restaurant also focuses on catering for the needs of students in the nearby campus by offering snacks. This is based on the fact that students may not be in a position of purchasing a full course of a meal. It also sells simple meals that can be considered as half course for the same reason.

Restaurant Layout

The restaurant will have four major areas that include the dining area, kitchen, lodge and food store, entrance, food store, and the office. The entrance area is very important for the restaurant since it is the one used by many customers to make a general judgment about the restaurants’ standards, quality, and all other aspects of businesses that a customer can consider to decide on the restaurant quality. It is used in making the first impression on a customer and thus, it should be carefully done.  Kitchen is the central point of any restaurant. In this regard, a kitchen requires having an adequate space to serve all the purpose of the restaurant. The actual kitchen size highly depends on the number of appliances required in the kitchen as well as how extensive the restaurant menu is.  Among the equipment that should be considered when developing the kitchen plan include ovens, cooking stoves, fryers, boilers, dish machine enough shelf, and triple sinks. The kitchen should also have prep section as well as industrial sink that should be accompanied by dry utensils storage area.

The storage area should be situated close to the kitchen to ensure easy accessibility. It should also have enough space to store all food products that the restaurant requires as ingredients to fulfill its menu requirement. Among the equipment to be put in the restaurant store include a dry storage area, walk-in freezer, and walk-in refrigerator. An office will also be essential to enhance the restaurant management. The office should occupy the smallest space possible. However, it should be located in the safest place possible normally, far from customers, and workers to ensure its safety.  The other important section is the employee area which is a section where employees can store their personal items, hang coats, and where managerial notice, work schedules and other work related memos can be managed.  The two other most important restaurant sections include the dining room and the restroom or lounge. The dining area design depends on the preference of the owners, the available space and the number of customers they intend to have on one sitting. They should also consider the best color to use and the form of lighting to apply. The designer should ensure a natural flow from the kitchen to the dining area and also to the lounge. The lounge should also be well designed and fitted with fixtures which will give the customers the comfort they would be seeking while visiting the lodge (All Food Business, 2013).

Garp Courier Service Case Study

Garp Courier Service (GARP) is a successful new business in the Washington DC area. The courier business is a very competitive industry. The key to GARP’s success is their unprecedented “money back guarantee” that all deliveries are completed within 30 minutes of receiving the call. GARP is growing fast and plans to establish service in other cities, starting with Baltimore.

Each of GARP 20 employees was hired with a handshake. On their first day employees are given a distinctive blue and red spandex body suit and a detailed employee handbook covering every aspect of the business from dress code and demeanor, to hours of service, pay, profit sharing and discipline. “This manual is the GARP bible. Lose it, or tell anyone our company policies and methods and you will be both fired and sued,” warned Tony Armstrong, the owner and manager. Regarding terminations the manual said all employees are conditional employees for one year. After successfully completing one year they would be considered “permanent” employees. Permanent employees are paid $40,000 per year with health benefits and are eligible for profit sharing. It also means they could be fired only for “cause” – a phrase never fully explained. The manual also says in tiny, 8-point type, on the next to last page, and after the signature page, that the manual is for “employee information purposes only and is not an employment contract.”
Homer Jones was GARP’s most successful courier. He was the first employee hired 3 years ago. He knew he was a fortunate recipient of Tony’s business system. He had the best list of clients and he worked very hard. He had to. Homer had a family to support including a little boy with heart problems. Homer realized, unlike other courier services, GARP couriers could ride and park their bikes anywhere – streets, sidewalks, even inside buildings. All doormen cooperated with GARP couriers; in contrast to the hostility they showed other couriers. Homer showed his appreciation; each Christmas he liberally handed out turkeys to friendly doormen, police officers and other “associates” who helped him.
GARP couriers have no trouble with the police. They did not obey traffic or street signs if they slow them down. If they get a ticket, unlike other couriers who pay the fine themselves, they just give the ticket to Tony. Homer tore through the city making twice as many deliveries as other couriers. Last year he earned a six-figure salary through salary, tips, bonus and profit sharing.

Due to his savvy, drive and experience Tony wanted Homer as his manager when decided to expand the business to Baltimore. Naturally, Homer was reluctant to give up his current job to start in a new city. But Tony Armstrong was uniquely persuasive. He said, “I got things set up. Go to Baltimore for a year and see how it goes. You can always get your job back here.” It was “an offer he could not refuse”. Homer relented and said goodbye to his comfortable job and life. His wife quit her job and the kids were removed from school and relocated in Baltimore where Homer bought a new house. As manager, Homer was guaranteed an annual salary, plus commissions on all deliveries and a higher percentage of company annual profits. The company also promised to hire 12 couriers within 3 months and have 20 hired within one year. The marketing budget called for huge increases in monthly increments through the first year.

On his first day of work Tony sat down with Homer and said; “this is “Management 101” at GARP, Homer. This is a list of police officers, government officials and doormen in the Baltimore area. Every name on the list gets $100 cash on the first day of each month.” When Homer asked why, Tony said “How you think we keep the cops from busting the couriers for the reckless riding they do? What gets those doormen to cooperate? This is just “appreciation money”. It ensures the cops, bureaucrats and other problems are taken care of. It’s why we can guarantee 30-minute deliveries, you idiot! You make these payments or we are just another courier service. Understand!?
Afraid to argue, yet not comfortable paying what he perceived as bribes, Homer tried to make the business work without them. He took the money but put it in the bank. Homer worked day and night, trying all kinds of marketing and operations strategies. He bought motorized scooters and found strategic partners. The business made money but failed to match the DC office. So Homer developed a business plan that aimed for comparable profits within a year. Proudly he took it to Tony; who said very little, but signed off on Homer’s plan.
After 3 months Tony and Homer were at odds. Tony never hired more than 3 couriers in Baltimore. When Homer asked Tony to follow through on his promises or give him his DC job back, Tony assured Homer the new hires were coming. Classical Conditioning can occasion the learning of extreme and irrational fears which are referred to as phobias. Failure to clean their rooms will result in no television or gaming time as a form of punishment. 1.Should terrorist organizations such as Al Qaeda be given prisoner of war status and thus be entitled under the rights of the Geneva Convention?
I do not believe members of Al Qaeda should be given POW status because their actions are not committed as part of any ‘war’. They are criminals, whose extremist beliefs have driven them to murder. However, I do believe when they are captured and detained that they do have rights under the Geneva Conventions because the Geneva Conventions are International treaties that were written for the purpose of ensuring humane treatment of individuals in custody. I take this position because we as a nation, must continue to uphold our integrity as a leader of human rights. The American Civil Liberties Union also holds the position that the US should not deter from its human rights leadership by detaining individuals indefinitely without charge, allowing torture of detainees, and acting unfairly toward immigrants (ACLU, n.d.) I agree with ACLU that we must uphold our moral authority by taking action to reject these injustices (ACLU, n.d). Even our current President, President Obama, holds the position of human treatment and respect of the US Constitution. I reviewed his remarks regarding National Security on May 21, 2009 and although he does make some valid points regarding transparency (not releasing photos for the safety of our servicemen and women), which I do agree with, he also makes it very clear that no matter what war or who we are fighting, we uphold our core values, act humanely, respect the rule of law and due process (Obama, 2009). He also said we are the nation that shut down torture chambers and replaced tyranny with the rule of law (Obama, 2009). This is true, we were leading by example and all of a sudden that changed after 9/11 with the policies. I agree with Obama, we need to get back on track.

1. Which system of justice would you advise the President to handle regarding captured terrorist? Domestic courts, military tribunals or something other?
Because these two different systems can’t seem to co-exist as they are, I would advise revision of the detention policy, as recommended by some Yale Law scholars. The Yale Law scholars also agree with ACLU and Obama’s position in that the US should uphold its moral principles. They propose the following principles be incorporated into the detention policy to help undo the damage done to our nation’s reputation and to uphold our moral principles (Ahmad,, 2009):

o Observe the rule of law by respecting international humanitarian law, ceasing to engage in run-arounds regarding the constitution and basic human rights.
o Make Liberty the norm by not detaining without trial or for preventative measures (incarceration is a result of what an individual has done, not may do)
o Individualized process should be carried out no matter the circumstance or the individual. Every person, even those suspected of terrorism should have the right to this process.
o Engage in Transparency with the public to establish credibility and legitimacy.


They go on to add that there should be judicial oversight, zero tolerance regarding torture of detainees, and overall adherence to the US Constitution (Ahmad,, 2009). I think if these principles were applied, the military tribunals would be sufficient.

I think judicial oversight is the best way to ensure checks and balances in the U.S. Constitution. As we have seen, the question of the Supreme Court’s authority keeps coming up but there should be no question because it is their oversight that enables the checks and balances for the protection of individual’s liberties. Can you cite two examples of this checks and balance? Two cases quickly come to mind as examples of this checks and balance: Rasul v. Bush and Korematsu v. United States. Both cases took Supreme Court rulings to ensure that our Constitution was upheld. As long as the Constitution always takes precedence, individuals’ liberties are protected.
2) Could checks and balances be limited during times of terrorist events or war? Why is this a good idea or a bad idea? Please explain your answers. I think the checks and balances can be limited as long as the Constitution, International laws, and Geneva Conventions are being respected. This can be a good idea when time is of the essence but the procedures must be iron-clad with regular monitoring and reporting to ensure the integrity of the procedures. Only in this situation can the involvement for judicial oversight be limited.

In all honestly, this question pumps and prods for a personal opinion in relation to the answer to question one of this week’s conference. As of right now, according to the Homeland Security Presidential Directive; “terrorists’ seek to destroy, incapacitate, or exploit critical infrastructure and key resources across the United States to threaten national security, cause mass casualties, weaken our economy, and damage public morale and confidence”. Personally speaking, I believe that each individual situation is different in regard to prisoner of war status for the question that is being asked. Following the breakdown of the cycle of terrorist and selecting a target and recruiting personnel to get a job done, utilizing personnel to prevent future attacks is an option. Creating harsh environments and not gaining intelligence and information should some be given a prisoner of war status and protected under the Geneva Convention may not always be the best option. In the past we have been a reactive nation and not necessarily a proactive one. Each criminal, each terrorist has breaking points and different situations just like no two humans are exactly alike (even twins have differences).

Within the justice department and the President handling the capture of terrorists, they are in a category all of their own. I have had the opportunity to understand and be a part of the domestic courts as well as military courts; although I am no subject matter expert in either one. I believe that a checks and balances of both would be quite interesting, meaning I would choose other. If a terrorist is captured or found on American soil (meaning not on some sort of military combat outpost or forward operating base in another country) than specifically domestic courts should be utilized. If a terrorist is captured during a deployment of troops than a military tribunal with the added benefit of the input of a domestic court should be utilized (in conjunction). I am not saying that one court system is better than the other, we are all doing the same job, protecting the same nation; what is so difficult about coming together to share knowledge and add joint decisions in the highest regard?

Checks and balances are important to the protection of individual civil liberties due to the fact that they were set up to not only avoid any sort of anarchy but to achieve justice and the correct and lawful way in correlation with law and the Constitution. “Madison felt that in a republic that the goal of it’s elected leaders should be to maintain the authority of the Constitution, which of course gets it’s authority from the people living under its laws.” Checks and balances are used so that the perception and interpretation of the Constitution is not only the correct one but it is adhered to and that the good of the people is understood and civil rights and liberties are maintained. Two examples of checks and balances would be the case between the New York Times and the United States in reference to the Pentagon Papers as well as one of our previously discussed court cases during class of Korematsu versus the United States.

I believe that checks and balances should not necessarily be limited during times of terrorist events or war, but could be if there is no other option. Regardless the process would be slowed down. Many court cases and reviews and trials are drawn out and lengthened when they are high profiled which would consist of a trial for terrorism or during a war. Many things need to be taken into consideration and the smallest hiccup could cause derogatory or negative results or actions. It is understood that time is of the essence in relation to terrorism, but not so vast that the Constitutional rights or laws are not adhered to in the process.
